KOTA KINABALU: A security guard stationed at a hospital was jailed for 36 months and ordered to be given three strokes of the cane by a Magistrate’s Court here on Monday for molesting a nurse.
Magistrate Stephanie Sherron Abbie imposed the sentence on Mohd Amin Zahari, 29, after he pleaded guilty to fondly touching the victim’s breasts and private parts by inserting his hand into her underwear.
The offence took place at the staff quarters here on July 5.
Mohd Amin was convicted under Section 354 of the Penal Code which provides for a jail term of up to 10 years and whipping and also liable to a fine or any two of the punishments, upon conviction.
The facts of the case stated that the victim was about to go to bath when she was grabbed by the accused inside her house to a room.
Inside the room, the accused tried to rape the victim and he had touched her breasts and private parts.
A scuffle broke out when the victim tried to fight the accused and shouted for help but the accused had strangled and smashed her head to the wall repeatedly.
The victim managed to get out from the house half naked and at the same time one of her neighbours was outside the house.
She followed her neighbour to her home to seek help and the neighbour saw the accused leave the victim’s house through a window at a toilet and went down by walking on the pipe.
The neighbour later asked the accused why he did that to the victim but he did not say anything.
The victim had then lodged a police report against the accused and at the crime scene, the police found a pair of gloves and a screwdriver.
Mohd Amin was arrested on the same day at 1pm.
The victim had received treatment and the doctor, who conducted a check on her, found that she had several bruises and various parts of her body were swollen.
In pleading for a lenient sentence, National Legal Aid Foundation counsel Lim Ming Zoong @ Lawrence, who represented Mohd Amin said that the accused, who is a father of three, was the sole breadwinner of his family.
