Senior cop jailed, fined for soliciting RM20,000 bribe from woman

KOTA KINABALU: The Sessions Court here today sentenced a senior police officer to two years’ jail plus RM25,000 fine, in default, five months’ imprisonment for corruptly asking cash from a woman as an inducement not to take action against her for an alleged cheating case.

Judge Abu Bakar Manat passed the sentences on DSP Mohd Mahyuddin Abdullah, 46, after finding the latter guilty of asking RM20,000 bribe from the woman at a car park at a café and bar at Lorong Austral, Taman Ridgeview, here on June 15, 2016.

The accused was convicted under Section 16(a)(B) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 which provides for a jail term of up to 20 years and fine of five times the amount involved or RM10,000, whichever is higher, upon conviction.

However, the judge allowed the accused’s application for a stay of his jail, which was counted from today and fine punishments, pending his appeal to the High Court here.

In the meantime, the accused was released on a bail with additional RM3,000 which must be paid by this coming Monday, pending disposal of the appeal.

As for the accused’s second and third charges, the court had acquitted and discharged the accused from both the charges.

The court freed the accused from both the charges after the court ruled that the defence had cast reasonable doubt on the prosecution’s case.

The second count alleged Mahyudin of receiving RM5,000 bribe from the same woman for the same purpose at a car park in front of a building here between June 15 and 18, 2016

On the third count, the accused had allegedly agreed to receive RM500 from the same person for the same purpose at a car park at a café and bar at Lorong Austral, Taman Ridgeview, here on June 15, 2016.

In pleading for a lenient sentence, the accused, who was represented by counsel Chin Tek Ming and Jul Hamri Jumhani, said that the accused had no previous conviction and the accused has been in service with Royal Malaysian Police since 1996.

Apart from that, the accused is married and has four kids.

In reply, the prosecution urged court to impose a deterrent sentence to serve as a lesson to the accused and would-be offenders in future.
