The suspect in the case of S Thava Sagayam, a security guard who died in August after he was assaulted in December last year, has now been charged with murder under Section 302 of the Penal Code
In a statement earlier today, 9 September, Perak police chief Dato’ Pahlawan Mior Faridalathrash Wahid said that the Attorney-General’s Chambers has agreed to amend the current assault charge to murder.
The Star reported that no plea was recorded from the suspect, Ahmad Noor Azhar Muhammad, after the murder charge was read to him before Magistrate Noor Azreen Liana Mohd Darus.
The 33-year-old suspect was previously charged under Section 335 of the Penal Code for voluntarily causing grievous hurt using a table at a condominium in Ipoh on 29 December 2020.
The case was then reclassified as murder after the victim died on Friday, 27 August, and amidst calls from the victim’s family, who said that they were forced to take to social media to demand justice.

According to the charge sheet, Ahmad Noor was accused of murdering Thava Sagayam between 8am and 9.30am on the seventh floor of Menara Majestic on Jalan CM Yusuff on 29 December.
Ipoh Barat member of Parliament (MP) and former minister M Kula Segaran, who is the watching brief lawyer for the guard’s wife E Philomena, said that they will continue to monitor the case.

No bail was offered as murder is a non-bailable offence.
The case has been set for mention on 18 October.
